I don't think you need their permission, I think you just need to inform them that you're recording the conversation. Though it doesn't sound like she did that either...

I imagine she and her lawyer had a microphone setup to capture her voice, and probably another little one that attached to the earpiece of the phone. So you're hearing his voice through the shitty phone speaker placed next to a mic, and you hear her voice directly though a quality microphone.

I, personally, would be surprised if this bitch hadn't been playing mind games with Mel for the past little while. Why even record the call? I certainly don't keep a recorder by the phone, but if I did I'm certain it would be able to get the conversation in full...
